Rafael Serrano is a partner at CorralRosales. Has more than 15 years of experience in Environmental and Data Protection and the Energy & Natural Resources and TMT industries.
Rafael has extensive experience in data protection, advising different companies within the banking, insurance, health, education, retail, technology, and security industries, among others. Rafael’s advice includes preparing programs and strategies for compliance with data protection regulations, execution of audits, data impact assessments, and preparation of policies, contracts, and data protection clauses. Rafael holds several certifications issued by the Asociación Profesional Española de Privacidad, the IAPP, and UCEMA.
In the Technology area, Rafael has been involved in projects related to e-commerce, artificial intelligence, the Internet of Things (“IoT”), cybersecurity, metaverse, Fintech, and digital assets. Within this area, Rafael advises in preparing policies for companies, negotiating and preparing contracts and clauses, advising on regulatory development, and obtaining permits, among other aspects.
In the environmental area, Rafael has extensive experience advising on compliance with environmental obligations, environmental liability extended liability protection, and climate change. His advisory services include obtaining administrative permits before the different environmental authorities, preparing preventive due diligence, preparing strategies and defense of clients before administrative sanctioning procedures, and preparing policies and compliance programs for carbon footprint reduction.
In the Natural Resources industry, Rafael has developed his practice in the mining, energy, and oil industries, advising clients on compliance with specific regulations. Rafael’s advisory to companies in the area of natural resources has a strong environmental component, focusing on compliance with the particular regulations for the sector. In the mining field, Rafael has advised on the financing of several of the most important mining projects in the country. In the energy sector, he has focused on advising self-generators and large consumers to obtain the benefits established in the regulations. In the oil industry, he develops strategies for regulatory compliance in environmental matters and community relations.
In addition to his work at CorralRosales, Rafael has been a professor at Universidad de las Américas of New Technologies Law, Environmental Law, and Real Rights. He is a founding member and was the first vice-president of the Ecuadorian Association of Data Protection (“AEPD”), a member of associations such as the Asociación Latinoamericana de Privacidad (“ALAP”), the International Association of Privacy Professional (“IAPP”) and Itechlaw (“Itechlaw”).
Rafael holds a law degree from the Pontificia Universidad Católica del Ecuador. He holds a Master’s in Energy and Natural Resources Law from the University of Melbourne. He specializes in Environmental Law from the Universidad Católica Argentina and New Technologies Law from the Universidad Católica Argentina. He has taken several postgraduate courses at foreign universities, among which the most important are in Tort Law, Banking and Financial Law, and Administrative Law at the Universidad Católica Argentina. He holds diplomas in artificial intelligence, metaverse, and gaming from the University of Buenos Aires and a diploma in blockchain and cryptoassets from UCEMA.
